1. Agreement and Operator

These Terms of Service (the "Terms") are a binding agreement between you and Enjoying interaction Corp, doing business as RareRush ("RareRush," "we," "us," or "our"), a California corporation located at 1179 Eager Road, Yuba City, California 95953, Sutter County, United States.

These Terms govern your access to and use of the RareRush mobile application, websites, product discovery and recommendation features, private product AI, customer support, purchasing and fulfillment services, Share Earnings, Rare Token, Value Growth, and related services (collectively, the "Services"). Our Privacy Policy explains our personal-information practices and is incorporated by reference for purposes of describing those practices, but privacy consent is obtained separately where required.

By creating an account or clicking a button or checkbox that clearly states you agree to these Terms, you accept these Terms and the version presented to you. Merely viewing a public page does not by itself create an account or purchase agreement. If you do not agree, do not create an account or use account-only or transaction features.

Checkout disclosures, product-page terms, preorder disclosures, return instructions, Share Earnings disclosures, and other terms presented for a specific feature or transaction also apply. If a specific disclosure conflicts with these Terms, the more specific disclosure controls for that feature or transaction, except that it cannot reduce rights that applicable law makes mandatory.

2. Eligibility and United States Scope

You must be at least 18 years old and legally able to enter into a contract to create an account, purchase a product, use product AI, participate in Share Earnings, or receive a payout. By accepting these Terms, you represent that you meet these requirements.

The account and transaction Services described in this version are offered in the United States. Purchases are available only for supported addresses in the contiguous 48 United States and the District of Columbia. We do not ship to Alaska, Hawaii, U.S. territories, APO/FPO/DPO addresses, or post-office boxes. Availability of an app or website outside the supported market does not create a right to register, transact, receive a payout, or use a feature there.

You may use the Services only if doing so is lawful where you are located and you are not prohibited or restricted under applicable U.S. sanctions or export-control laws.

3. Accounts and Authentication

You must provide accurate, current information and keep it updated. You may not impersonate another person, create an account for someone under 18, transfer or sell an account, or use another person's account without authorization.

You are responsible for safeguarding your password, email account, device, one-time codes, and sign-in credentials. Notify support@rarerush.ai promptly if you suspect unauthorized access. We may require reauthentication or additional verification before changing sensitive information, issuing a refund, deleting an account, or enabling a payout.

If you sign in with Apple or Google, your use of that provider also remains subject to its terms. RareRush may link sign-in methods that resolve to the same verified account. You remain responsible for access to the email address or provider account used for authentication.

4. Limited License to Use the Services

Subject to these Terms, RareRush grants you a personal, limited, revocable, non-exclusive, non-sublicensable, and non-transferable license to access and use the Services for lawful personal use on devices you own or control, subject to applicable app-store usage rules.

Except as permitted by law or with our written permission, you may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, extract source code from, scrape, probe, interfere with, or create derivative services from the app, software, recommendation system, AI prompts, non-public APIs, or other technology. This license ends when your account or access ends.

5. Products, Fixed SKUs, and Product Information

Each product listing represents a specific SKU with a fixed size, material, frame or finish, and other displayed attributes. You may review those attributes and decide whether to purchase that SKU, but you cannot customize or change its size or configuration unless the listing expressly offers that option. A different size or configuration is a different SKU.

Product photographs, renders, and previews are intended to show the product, but screens, lighting, production materials, and normal manufacturing tolerances may cause reasonable differences in color, texture, scale, or finish. The listing and payment-time order record—not an AI message, marketing statement outside the listing, or later catalog price—define the purchased SKU and price.

Some artwork, product concepts, descriptions, or previews may be created or assisted by artificial intelligence. Purchasing a physical product does not mean that the work was made by a human artist or that copyright protection or exclusivity is guaranteed.

We may correct clear typographical or pricing errors before accepting payment. After payment succeeds, the price charged for that order is locked. Later price changes apply only to later purchases: we do not charge you more, automatically refund a difference, or treat a later catalog price as an amount owed to you.

6. Orders, Prices, Payments, and Taxes

Prices are shown in U.S. dollars. Standard shipping to a supported address is currently included at no additional shipping charge. Applicable sales or use tax is calculated at checkout. The checkout total and its price, tax, shipping-discount, preorder, and policy snapshots are preserved with the order.

RareRush uses Stripe to process cards, supported saved payment methods, Apple Pay, and Google Pay. These are payment methods for physical goods and are not Apple in-app purchases or Google Play digital purchases. You authorize RareRush and Stripe to charge the payment method you select for the amount displayed at confirmation. A bank authorization, pending hold, or client-side success screen does not by itself prove payment; our order status is finalized from verified payment-provider records.

An order is accepted when RareRush confirms successful payment and creates the paid order. We may reject or cancel an order before shipment for payment failure, fraud or sanctions risk, unsupported address, product or legal restriction, obvious error, or inability to fulfill. If we cancel a paid, unshipped item, we will submit a full refund for that item and its associated tax to the original payment method.

Quantity, cart, or risk limits displayed in the Services may apply. Attempts to evade technical, fraud, sanctions, market, or operational controls through multiple accounts or orders may be rejected. Ordinary placement of more than one legitimate order is not prohibited merely because the orders are separate.

7. Preorders, Production Threshold, and 180-Day Shipping Promise

RareRush products may be sold through a demand-based preorder model:

  • your selected payment method is charged when you place the order, not when production begins or the item ships;
  • paid, non-refunded units count toward the specific SKU's production threshold;
  • when that threshold is reached, the SKU automatically enters production; and
  • different SKUs in the same order may reach their thresholds, enter production, and ship at different times.

Shipping promise

For each paid preorder item, RareRush promises that the item will receive its first carrier acceptance scan no later than 180 calendar days after successful payment, unless you later affirmatively agree to continue waiting under the delay process below. This is a promise about first carrier acceptance, not final delivery. RareRush does not provide a more specific estimated production, ship, or delivery date unless one is expressly included in your order record.

RareRush must have a reasonable operational basis for the 180-day promise when accepting an order. Payment does not guarantee that a threshold will be reached; if the item cannot be shipped within the promised period, the delay and refund rules below apply.

Cancellation before first carrier acceptance

You may cancel any quantity of an item that has not received its first carrier acceptance scan at any time, including after production has started. We will submit a full refund of the canceled item amount and associated tax to the original payment method. An item that has received its first carrier acceptance scan is handled under the return and shipping-issue rules instead.

Delay process

If we learn that an item cannot receive its first carrier acceptance scan within the promised 180 days, we will provide a clear delay notice and let you choose between:

  1. canceling the affected unshipped item for a full refund; or
  2. affirmatively asking us to keep the item open while you continue waiting.

If you decline the delay, or if we have not received your affirmative agreement by the original 180-day deadline, we will automatically cancel and submit a full refund for the affected unshipped item. If you affirmatively choose to continue waiting, you may still cancel for a full refund at any time before first carrier acceptance. Unless we provide a definite revised date in writing, continuing to wait does not create a new promised shipment date.

Each SKU is handled independently. We may split an order into multiple shipments at no extra shipping charge. Shipment of one item does not prevent cancellation of another item that has not received first carrier acceptance.

8. Shipping, Customs, Delivery, and Address Changes

Products may be manufactured and shipped from mainland China. For supported U.S. addresses, RareRush arranges shipping on a delivered-duty-paid basis: the customer will not be required to act as importer of record or pay additional import duties, tariffs, or customs-clearance charges at delivery.

We provide available carrier and tracking information after shipment. Delivery timing after first carrier acceptance depends on customs and carrier operations and is not guaranteed unless your order expressly states otherwise. Risk of loss remains with RareRush until confirmed delivery to the valid shipping address, except to the extent a loss is caused by your unauthorized redirection or other conduct after carrier acceptance.

You must provide a complete, accurate, supported address. You cannot overwrite the paid order's address snapshot yourself. Before first carrier acceptance, customer support may process an address-correction request after revalidating market eligibility, tax, fraud, fulfillment, and customs requirements. If the correction changes the amount or makes the order unsupported, the affected item must be canceled and ordered again. After first carrier acceptance, changes are limited to carrier-authorized redirection or return procedures.

If a carrier confirms loss or transit damage, RareRush will offer a refund or, with your agreement and subject to availability, a replacement at no additional product or shipping charge. You do not need to pursue the carrier directly. If delivery fails because you supplied an incorrect address, refused delivery without a valid product or shipping issue, or did not collect a held parcel, we may charge only documented, reasonable reshipment costs—not a penalty—before reshipping.

9. Returns, Product Issues, and Refunds

30-day return window

You may request a return authorization within 30 calendar days after confirmed delivery of the affected item. Contact support and obtain return instructions before sending anything. Unauthorized returns, cash-on-delivery shipments, or items sent to an unapproved address may be rejected.

For a change-of-mind return, the item must be returned in substantially the condition received, subject to reasonable inspection. The customer pays the return-shipping cost. RareRush does not charge a restocking fee and does not deduct the original free-shipping cost from the product refund.

If the item is incorrect, materially damaged in transit, missing parts, defective, or materially different from its listing, RareRush pays reasonable return shipping and offers a refund or, with your agreement and subject to availability, a replacement. We may request reasonable photos or other evidence needed to verify and resolve the issue.

Unless RareRush expressly offers an exchange, the standard remedy is return and refund; you may place a new order for another SKU. Refunds are based on the amount actually paid for the returned unit and associated tax, not a later catalog price or Value Growth display.

Refund timing and method

Refunds are made only to the original payment method, except where the provider cannot legally or technically return funds that way. For an automatically approved preorder cancellation, we submit the refund to Stripe promptly. For a return, we submit an approved refund within two business days after the authorized return is received and inspected. Stripe, the card network, wallet provider, and your financial institution control how long the credit takes to appear after submission.

We support item-level and quantity-level refunds. A partial refund includes the tax allocable to the refunded item or quantity. Refund and chargeback activity may reverse related Rare Token, purchase ranking, Share Earnings, or other benefits tied to the refunded unit.

Nothing in this Section limits a non-waivable warranty, chargeback, refund, or consumer right under applicable law.

10. Private Product AI and AI-Assisted Support

Signed-in users may use a persistent, private one-to-one AI conversation associated with a product. It is not a public group chat and is not visible to other users. RareRush uses DeepSeek to generate replies and OpenAI to moderate product-AI inputs and outputs before accepted content is stored or displayed. You may report an eligible stored AI reply for review.

AI output is generated automatically and may be inaccurate, incomplete, outdated, biased, or unsuitable. It does not establish or change a product's price, dimensions, materials, availability, preorder status, production status, order status, refund eligibility, shipping promise, legal rights, or any other authoritative fact. Use the product listing, checkout record, order page, written policy, or human support response for those facts.

AI output is for general product interaction and is not legal, medical, financial, tax, safety, or other professional advice. Do not rely on it as the sole basis for an important decision.

You may not use AI features to generate, request, or transmit content that is illegal, threatening, exploitative, sexually abusive, hateful, harassing, fraudulent, infringing, malicious, intended to defeat safety controls, or otherwise prohibited by law or these Terms. Do not submit another person's confidential or personal information without authority. We may reject content, pause generation, preserve required safety evidence, restrict AI access, or refer a credible imminent threat or illegal activity to appropriate authorities.

AI-assisted customer-support replies may be reviewed, corrected, or replaced by authorized personnel. A generated reply does not waive a policy requirement or bind RareRush unless it is confirmed through an authorized transaction record or written decision.

11. Content You Submit

You retain any rights you have in lawful prompts, messages, photos, feedback, or other content you submit ("User Content"). You grant RareRush a worldwide, non-exclusive, royalty-free license to host, copy, transmit, format, analyze, moderate, and otherwise process User Content only as reasonably necessary to operate, secure, support, and improve the Services, fulfill your requests, comply with law, and enforce these Terms. This license ends when the content is deleted, except for copies lawfully retained in backups, transaction records, safety evidence, de-identified data, or legal holds.

You represent that you have the rights and permissions needed to submit User Content and that our processing of it as described will not violate law or another person's rights. Do not submit confidential, copyrighted, private, or personal material that you are not authorized to provide.

Feedback about RareRush may be used without payment or obligation to you, provided we do not publicly identify you without permission.

12. RareRush Intellectual Property and Physical Artwork

The Services, software, brand, logos, interface, product catalog, original text and graphics, selection and arrangement, and related intellectual property belong to RareRush or its licensors. These Terms do not transfer any intellectual-property ownership to you.

Purchasing a decorative-art product transfers ownership of the physical item after delivery and payment, subject to these Terms. It does not transfer copyright, trademark rights, model rights, source files, exclusivity, or a right to reproduce, sell copies of, tokenize, train models on, or commercially exploit the artwork or design, except to the extent a product listing or separate written license expressly says otherwise. You may display the lawfully purchased physical item for personal use and may resell that physical item, subject to applicable law.

If you believe content in the Services infringes your intellectual-property rights, email support@rarerush.ai with your contact information, identification of the work and challenged content, the location of the content, a good-faith explanation, and a statement that your submission is accurate and authorized. Do not knowingly submit a false claim.

13. Share Earnings Program

Share Earnings is a single-tier referral program for eligible U.S. users age 18 or older. It is not employment, a franchise, a partnership, an investment, a multilevel-marketing program, or a promise of income. Participation is optional and subject to this Section and the disclosures presented when you create or use a share link.

Eligibility and attribution

  • You may share a product only while you hold at least one paid, non-refunded unit of that product and your account remains eligible.
  • An eligible purchase is attributed to the last valid click or manually entered code for that SKU during the preceding 30 days. The purchaser must be able to see and remove the attribution before checkout.
  • We do not use device fingerprinting to create attribution and do not promise attribution when a platform, browser, device change, deleted storage, blocked link, unsupported deferred deep link, or missing code prevents reliable attribution.
  • Purchasing through your own link or code does not earn commission. Related accounts, collusive orders, fraud, spam, manipulated traffic, and attempts to evade attribution rules are ineligible.

Commission

The standard commission is 5% of the amount actually paid for the eligible product unit, excluding tax and any amount later refunded, disputed, charged back, or otherwise reversed. No commission is paid on taxes, shipping, duties, tips, coupons not funded by the purchaser, or non-product amounts.

Commission remains pending until the referred unit has been delivered, its 30-day return period has ended, and an additional seven-day risk period has passed—normally about 37 days after delivery. A return, refund, chargeback, payment failure, fraudulent purchase, eligibility reversal, or full refund that ends the sharer's qualification may cancel or reverse related commission.

If a reversal occurs after funds become available or are paid out, RareRush may apply a negative balance and offset it against future commission. We will not debit your personal bank account for a negative program balance without separate legal authorization.

Disclosure and marketing conduct

Whenever you recommend a product or publish a RareRush link or code in a context where you may earn money, you must clearly and conspicuously disclose the financial relationship close to the recommendation. A clear example is: "I may earn a commission if you purchase through this link." The disclosure must be visible with the recommendation and cannot be hidden only in a profile, terms page, group of hashtags, or after a "more" link.

Your statements must reflect your honest experience and must not be false, misleading, unsubstantiated, or inconsistent with the product listing. You may not claim guaranteed demand, profit, appreciation, investment returns, resale value, health benefits, limited inventory, delivery timing, human authorship, or product characteristics that RareRush has not authorized and substantiated. You may not use spam, unsolicited bulk messaging, deceptive redirects, impersonation, paid search using RareRush trademarks without permission, illegal incentives, fake reviews, or content directed to minors.

RareRush may provide approved product assets and a limited, revocable right to use the RareRush name solely to identify the linked product and disclose your relationship. You may not imply that you are RareRush, an employee, an agent authorized to bind RareRush, or an officially endorsed spokesperson.

Stripe onboarding, payouts, and taxes

Payouts require a supported U.S. Stripe Express connected account, successful identity and eligibility verification, active transfer and payout capability, and any tax information required by Stripe or law. Stripe—not RareRush—collects and verifies full KYC and bank information through its hosted interface.

The minimum available balance for a payout request is US$25. Each payout request withdraws the user's full available whole-cent balance; partial or instant payout requests are not offered. RareRush pays the standard platform-side cost for ordinary ACH or standard Stripe payout; charges imposed by your bank, currency conversion, tax authority, or a service you independently select remain your responsibility. Payout timing is not guaranteed and may be delayed by verification, Stripe review, bank processing, sanctions screening, fraud review, reserve needs, system recovery, or law.

You are responsible for determining and paying taxes on Share Earnings. RareRush or Stripe may request tax forms, report payments, or withhold amounts when legally required. You are an independent program participant and have no authority to bind RareRush.

We may suspend attribution or payouts while investigating suspected fraud, legal violations, disclosure failures, platform abuse, chargeback risk, or account compromise. We will preserve already earned, non-reversed amounts unless law, fraud findings, these disclosed rules, or a valid offset permits adjustment.

14. Rare Token and Early-Purchase Rewards

Rare Token and related points or early-purchase rewards are limited, account-based promotional records. They are not money, cryptocurrency, stored value, a security, property held for investment, or a promise of profit. They cannot be purchased, sold, transferred, gifted, withdrawn, exchanged for cash, or used outside RareRush.

The Services may display earned and pending balances. Rare Token currently has no spending or redemption function. If an order or qualifying event is refunded, reversed, duplicated, fraudulent, or recorded in error, related pending or settled rewards may be corrected or reversed. We may correct technical or accounting errors but will not arbitrarily alter an accurately earned balance.

Rare Token is tied to the account and ends when the account is deleted. No cash or replacement value is payable for an unused balance.

15. Value Growth

Value Growth is an informational view derived from authoritative order-unit records, historical catalog prices, and refund status. It may show how a product's later catalog price compares with the amount paid for an eligible unit.

Value Growth is not cash, account equity, a guaranteed gain, a redemption amount, an appraisal, an investment return, a security, a promise that RareRush or another person will repurchase the item, or evidence of a resale market. A catalog price can rise or fall and does not establish what a used physical item can be sold for. You should not purchase a product in expectation of financial profit.

16. Prohibited Conduct

You may not:

  • violate law, sanctions, another person's rights, or these Terms;
  • commit or facilitate fraud, chargeback abuse, refund abuse, account takeover, money laundering, tax evasion, or identity misrepresentation;
  • interfere with security, rate limits, access controls, payment or payout controls, moderation, recommendation integrity, preorder counts, rankings, referral attribution, or product availability;
  • use bots, scripts, scraping, automated accounts, or coordinated behavior without written permission;
  • upload malware or attempt unauthorized access, testing, scanning, or disruption;
  • harvest, expose, or misuse another person's personal information;
  • create fake engagement, orders, reviews, referrals, returns, reports, or support claims;
  • resell access to the Services or use them to build a competing service without permission; or
  • encourage or assist another person to do any of the above.

17. Service and Electronic Communications

You agree that we may send electronic communications necessary to operate your account and transactions, including authentication codes, receipts, payment and refund notices, preorder-delay choices, production or shipping updates, security alerts, policy notices, support replies, and payout notices. These are service communications, not marketing, and disabling optional notifications does not prevent communications required to complete or protect a transaction.

We do not send marketing messages without any consent required by law. You may control optional device notifications in your operating-system settings.

18. Privacy

Our Privacy Policy describes how RareRush handles personal information, including product-AI content, recommendation activity, payment records, Stripe Connect status, fulfillment in China, data retention, account deletion, and privacy rights. Review it before creating an account or using the Services.

19. Third-Party Services and Mobile Platforms

The Services rely on third parties such as Stripe, Apple, Google, DeepSeek, OpenAI, cloud providers, and carriers. Their independent services are subject to their terms and policies. RareRush is responsible for its Services and obligations under these Terms; a third party is not responsible for RareRush products, fulfillment, refunds, product AI, Share Earnings, or customer support merely because its technology is used.

Apple devices

If you obtained the iOS app through Apple's App Store, the license to the iOS application is governed by Apple's Standard Licensed Application End User License Agreement and applicable Apple usage rules. These RareRush Terms separately govern your RareRush account, physical-product transactions, AI features, Share Earnings, and other Services. Apple is not the seller of RareRush physical products and is not responsible for those transactions or for RareRush customer support.

Google Play

If you obtained the Android app through Google Play, your use must also comply with applicable Google Play terms. Google is not the seller of RareRush physical products and is not responsible for those transactions or for RareRush customer support.

20. Suspension, Termination, and Account Deletion

You may stop using the Services and request account deletion as described in the Privacy Policy. Account deletion does not cancel an order, refund, return, chargeback, investigation, tax record, commission reversal, or payout already in progress.

We may restrict or suspend access when reasonably necessary to protect an account, investigate suspected fraud or unlawful conduct, comply with law, prevent harm, address a material breach, or protect the Services. When appropriate, we will give notice and a reasonable opportunity to resolve the issue. We may terminate an account for serious or repeated violations, fraud, threats, illegal activity, or abuse of users, staff, payments, refunds, AI, or Share Earnings.

Termination ends the app and service license but does not erase payment obligations, completed transactions, accrued lawful claims, required records, refund rights, non-reversed payable commission, or provisions that by their nature must survive. Sections concerning ownership, transaction records, reversals, disclaimers, liability, disputes, and general terms survive as applicable.

21. Disclaimers and Warranties

RareRush will honor express promises in the applicable product listing, checkout record, and these Terms, as well as warranties and consumer rights that cannot lawfully be disclaimed.

Except for those promises and to the maximum extent permitted by law, the app, website, recommendation features, AI features, informational displays, and related digital Services are provided on an "as is" and "as available" basis. We do not promise uninterrupted or error-free operation, that every product will reach its preorder threshold, that AI output will be accurate, that recommendations will match your preferences, or that a catalog price or Value Growth display will increase or create resale demand.

To the maximum extent permitted by law, we disclaim implied warranties concerning the digital Services, including merchantability, fitness for a particular purpose, and non-infringement. These disclaimers do not apply where prohibited and do not limit express product obligations, personal-injury liability, product liability, fraud, gross negligence, willful misconduct, or mandatory consumer rights.

22. Limitation of Liability

To the maximum extent permitted by law, neither RareRush nor its directors, officers, employees, or agents will be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or for lost profits, revenues, data, goodwill, or opportunities, arising from the digital Services or these Terms, when such damages were not a direct and reasonably foreseeable result of RareRush's breach.

To the maximum extent permitted by law, RareRush's aggregate liability for claims arising from the digital Services during any 12-month period will not exceed the greater of (a) the amount you paid RareRush for the affected product or Service during that period or (b) US$100.

The exclusions and cap do not apply to refunds or product remedies expressly owed under these Terms; personal injury or property damage caused by a defective product; fraud; gross negligence; willful misconduct; infringement claims for which RareRush is legally responsible; breach of confidentiality or data-security obligations where liability cannot be limited; or rights and remedies that applicable law does not permit us to limit.

Some jurisdictions do not allow certain limitations, so some of this Section may not apply to you.

23. Your Responsibility for Misuse

To the extent permitted by law, you are responsible for losses and third-party claims caused by your fraud, illegal conduct, willful misuse of the Services, unauthorized infringement, or material breach of these Terms. You agree to defend and indemnify RareRush against such third-party claims, but not to the extent a claim was caused by RareRush's own negligence, unlawful conduct, product defect, or breach. RareRush will provide reasonable notice and will not settle a claim in a way that admits your personal wrongdoing or imposes a non-monetary obligation on you without your consent.

24. Governing Law and Disputes

Before filing a lawsuit, you and RareRush are encouraged—but not required—to contact the other party and make a good-faith effort to resolve the dispute. Contact RareRush at support@rarerush.ai and include enough information to identify the account, transaction, issue, and requested resolution.

These Terms are governed by the laws of the State of California and applicable federal law, without regard to conflict-of-law rules. Subject to any non-waivable right to bring a claim elsewhere, the state courts located in Sutter County, California, and the federal court with jurisdiction over Sutter County will have exclusive jurisdiction.

These Terms do not require private arbitration and do not contain a class-action waiver. Nothing in these Terms prevents either party from bringing an eligible claim in small-claims court or seeking urgent injunctive relief, and nothing waives mandatory consumer rights or protections of the jurisdiction whose law must apply to you.

25. Changes to These Terms

We may update these Terms when the Services, law, providers, or business practices change. For a material change, we will provide reasonable advance notice and request renewed acceptance when required. The updated Terms apply prospectively from their effective date.

We will not retroactively change a paid order's locked price, payment-time shipping promise, return right, or earned and non-reversed commission merely by updating these Terms. A feature-specific change may apply to new transactions or new program activity after notice.

26. General Terms

If a provision is unenforceable, it will be enforced to the maximum lawful extent and the remainder will remain effective. Our failure to enforce a provision is not a waiver.
